Terms of Service

All services provided by HostDare (Registered company "Hostsymbol Pte. Ltd." and and hereinafter referred to as "HostDare" ) may be used for lawful purposes only. This Terms of Service ("TOS") govern your use of the Services with our company. HostDare may modify them at any time without notice.

The Services provided by HostDare may only be used for lawful purposes. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Services. HostDare reserves the right to refuse service to anyone. Any material that in our judgment violates these terms in any manner may be removed from our servers (or otherwise disabled), with or without notice.

Prohibited Uses

This list may not be fully exhaustive. If you have any question whether an activity is prohbited, please do not hesitate to contact us. The following activities are strictly prohibited:

• Illegal Content: Content/Activities which violate local, state, national, or international laws or regulations.
• Child Pornography: Content that is potentially harmful to minors, as determined in HostDare’s sole discretion, is strictly forbidden, including but not limited to, child pornography or content perceived to be child pornography. Any website found to host child pornography or linking to child pornography will be suspended immediately without notice.
• Resource Intensive Contet: Any content/activities that involve high CPU/Bandwidth usage, I/O usage and network usage, or in any other way disrupting the performance of other customer. We may take appropriate action, such as limiting resource allocation or suspending your account, if your resource usage negatively impacts the Service's performance or other users' experiences.
• Unauthorized port scanning, for any reason, is strictly prohibited. Customers are NOT permitted to utilize and deploy our services to conduct and deliver DOS/DDOS mitigation as a service.
• Copyright Infringement: Use of the Services to infringe upon another party’s intellectual property rights is prohibited. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software/warez, or any other copyrighted work. Selling or offering to sell any counterfeit merchandise will result in the immediate termination of your account. Any account found to be infringing on the intellectual property rights of others will be expeditiously removed or access to the material will be disabled. Any account found to be in repeated violation of this prohibition will be suspended or terminated.
  
  If you believe that your intellectual property rights are being infringed upon, please email [email protected]. For copyright infringement claims, HostDare follows the Digital Millennium Copyright Act ("DMCA") notice and takedown procedures.
• Deception: Engaging in any kind of phishing, deceptive or fraudulent activity.
• Spamming: Sending unsolicited bulk or commercial information over the Internet. It not only harms our reputation but also disrupts our network.
• Audio/Video Streaming: Hosting audio or video streaming content in shared hosting is not permitted and may result in account suspension or termination.
• Large File Hosting: Do not use our service for file hosting and distribution. Files larger than 50MB intended for download are not allowed. You may not use a shared hosting account as a backup/storage device with the exception of one cPanel backup of the same account. Please do not take backups of your backups. (Applies to shared hosting and reseller hosting only.)
• Obscene Speech or Materials: Transmitting, storing, or displaying kind of obscene materials such forced sex,rape,non-consensual sexually explicit imagery or videography are strictly forbidden.
• Defamatory or Abusive Language: Using our network to transmit abusive, defamatory, harassive or threatening language towards other users or any individuals is not allowed.
• Forging of Headers: Forging or misrepresenting message headers to conceal the message's origin is prohibited.
• Illegal Access: Unauthorized access to any computers or networks(including but not limited to Hostdare), including hacking or any precursor activities, is not permitted.
• Distribution of Destructive Activities: Distributing viruses, worms, Trojan horses,spyware,malware any other software or data intending to cause harm or engaging in activities that disrupt the network or other systems is strictly prohibited.
• Facilitation of Violations: Advertising, transmitting, or providing software, programs, or services that facilitate spamming,spying, hacking, or piracy is not allowed.
• Botnet hosting: Any kind of botnet,malware distribution service ,command and control server for any kind of malware are not allowed.
• Other Illegal Activities: Engaging in any unlawful activities, including fraud, is not allowed.
• Other Harmful Activities: Engaging in activities that harm HostDare, its subscribers, or its reputation is prohibited.

Content Guidelines

• You are solely responsible for all content hosted or transmitted through our Service. Do not use the Service to host illegal, offensive, harmful, or rights-violating content.
• We reserve the right to monitor and review content hosted on our servers and may remove or disable access to any content that violates these terms.

Zero Tolerance Spam Policy

• We take a zero tolerance stance against the sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists," purchased lists, and selling of lists will be treated as spam. We may terminate the account of any User who sends out spam with or without notice.
• Websites advertised via spam (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to, spam sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. Any User account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
• HostDare reserves the right to require changes or disable as necessary, any website, account, database, or other component that does not comply with our policies, or to make any such modifications in an emergency that we deem necessary at our sole discretion.
• HostDare reserves the right to charge the holder of the account used to send any unsolicited e-mail a cleanup fee or any charges incurred for blacklist removal at our sole discretion.

Defamation Policy

Websites hosted on HostDare’s servers in the U.S. are regulated by U.S. law. Accordingly, pursuant to Section 230(c) of the Communications Decency Act, HostDare’s policy is not to remove allegedly defamatory material from websites hosted on our servers unless the material has been found to be defamatory by a court, as evidenced by a court order. As a webhost, HostDare is not a publisher of User content and we are not in a position to investigate the veracity of individual defamation claims. We rely on the legal system and the courts to determine whether or not material is indeed defamatory. In any case in which a court order indicates that material is defamatory, libelous, or slanderous in nature, we will disable access to the material. Similarly, in any case in which a U.S. court has placed an injunction against specified content or material being made available, we will comply and remove or disable access to the material in question.

Backups

We do not take backups of client websites/VPS data on weekly basis. Customers should not rely us for backups. We highly recommends that clients backup their data to their personal computers or remote storage servers. Clients are responsible for their own data. We shall by no means be responsible for data loss .We are also not responsible for any damage due to backup failure which can cause financial or legal issues for the customers.We are not any way liable for loss of data if customers do not pay on or before due date.

Payments

Chargebacks or payments that are disputed whether intentionally or uninteionally will be reviewed. If any customer is found to dispute transaction with fvinancial institutions after committing fraud or using our services in any abusive manner, it will attract fine upto 250 USD for staff time. Services that are purchased by means of fraudulent payments will be immediately suspended or terminated. Data on terminated services will be deleted.
All credit card payments have to go through additional verification for Address and card.

Refund Policy

We offer 30 days money back gurantee on certain products such as shared hosting. There needs to be valid reason for refunds which will be dedcided by our management. Any abusive account is not eligible for refunds. Please check our terms of service for unaceptable contents policy.Trial or promo offers if the discount coupons used, such products are not eligible for refunds. Some products such as SSL, Cloud KVM VPS, Premium VPS, Dedicated IP addon, Domains, Dedicated Servers are not eligible for refunds.

Policy Violations

Resellers:If there is a violation of this Terms of Service by one of a reseller’s client’s account, HostDare will suspend the website in question and will notify the reseller so that the reseller can terminate the account. HostDare may, but is not obligated to, monitor the account or website for any subsequent violations. The occurrence of additional violations may result in the immediate termination of your reseller account.

Direct customers:Your Services may be terminated with or without notice upon any violation of this Terms of Service. If applicable, violations will be reported to the appropriate law enforcement agency.

Violation handling procedures:HostDare reserves the right to investigate suspected terms violations. We may take corrective action, including account suspension or termination, to stop harmful activities.

We do not routinely monitor private electronic activity, but we may do so while investigating abuse incidents to ensure the system's proper operation, comply with legal obligations, or protect our network and subscribers.

A failure to respond to an email from our abuse department within forty-eight (48) hours, or as otherwise specified in the email, may result in the suspension or termination of your Services. All abuse issues must be dealt with via trouble ticket/email and will receive a response within forty-eight (48) hours.

We may disclose information when required by law or to protect HostDare, its subscribers, or the public.
